Me too Gilbert!
It would be interesting to know if any other LATOs have had this shoved in
their face!
It's a 1991 Act and I assume, as an industry, we haven't ever questioned the
contents.
On a related but separate issue, one county council highways department near
me refuses to adopt service roads in new housing estates if it is proposed to
plant trees in the roadside paths or verges.

The Water Industries Act seems to be the force behind it and the
implications are quite serious. With the extension of adopted sewers
into private space it means that the options available for tree planting
on new developments is severely restricted. Jerry has attached a copy of
the 'trees and distances' table. This feeds the debate about the lack of
large trees in urban areas to the extent that a lot of the deabate might
have slipped out the back door without us/me noticing.

Gilbert
Is this referring to The Water Industries Act 1991?

A new one for me, I hesitate to say, but I have just had a landscaping
DOC application that effectively offers very little new tree planting on
a development of 44 dwellings citing the document "Adoption of Sewers"
as the reason why they can't. Can anyone offer any advice please?
