Morning,
I recently served a TPO, and have since determined that a couple of
trees need to be removed from the order, and a couple of others need to
be added. If I was just removing the trees then I could happily do this
at confirmation stage, but as I'm looking to add trees I was considering
whether I could issue a variation order, allow all relevant parties
their 28 days to make representations to the variation order and then
confirm both the TPO and the variation order at the same time.
The 2012 regs doesn't say that a TPO needs to be initially confirmed
before it can be varied, but the new web based "blue book" refers, at
one point, to a council being able to "vary their confirmed orders".
Although, it doesn't explicitly state that we can't vary an unconfirmed
order.
Anyone had any experience?
