RE: Chickens and TPO's

I can't say as to chickens, but I have a vague memory of possible
prosecutions of a farmer (somewhere in Surrey, I think - maybe Reigate?) for
letting loose wild boar in protected woodland.

I suppose you could argue that ther is no difference in principle between
using a wild boar, or I suppose a chicken, as an alternative to the more
conventional chainsaw. However, the Regs refer to "no person may ...
wilfully damage .. [a protected tree]... or cause or permit any of [those]
activities". I am slightly doubtful as to whether you could make it stick.

On the other hand, if someone tarmacs over the root system of a tree, in such
a way that it will almost inevitably damaged, that could be said to causing
damage, such as to found a prosecution; so why not damage by chickens?

I shall be interested to see any other responses.

Best wishes,

Charles Mynors

Subject: Chickens and TPO's

I recently had a question regarding the effect of chickens on trees, the
Farmer is planning on putting 3000 chickens in a field on a strip of land
with existing TPO's. Has anyone ever had any experience of how that fits
within the planning framework of damage to trees covered by TPO's?
