It sometimes happens that a developer argues the need for a certain intensity 
of development on the grounds of viability. Typically for the tree officer 
the space occupied by a tree may be required for a unit otherwise the 
development ceases to be viable.

I wonder if other LPA's out there subject arguments about viability around an 
application to expert or independent scrutiny?

Personally I might think to myself "you paid X for the site, that was your 
risk" but this is bound to be simplistic or even plain wrong. I wouldn't mind 
knowing a bit more about the subject, just out of idle curiosity you 
understand.
