Equalities Act 2010 and tree works applications

Dear All

I am dealing with a tree application to fell a horse chestnut and the 
applicant is claiming that under the Equalities Act I should allow them to 
fell the tree because the owners are disabled and cannot look after it now.

Can anyone advise what regard I should take of the fact that they are 
disabled or point me in the direction of some cases. I would refuse 
permission to fell the tree under normal circumstances.
