We have used sturdy damproofing plastics which seemed to do the trick.
Perhaps as the excavation is 're filled some crushed rocks could be 
introduced to provide a base for roots to grow around and adding good 
anchorage for future tree development and stability.

I have found that any kind of barrier to the development of a normal root
system *can* lead to catastrophic failure. Not to say that they should be
banned; only that careful consideration should be given to the facts of
each context.
