RE: AIA's and TPO's

A few observations

Some LPA's show all their TPO's on the planning website.

A recent site visit after contact with TO revealed the TPO tree removed some
time ago!

Sometimes it's easy to establish existence of TPO's with client.

I have written reports and not mentioned TPO's on instruction of client, but
objectors can jump on that fact.

I have only experienced once, TPO placed on all trees over site only because
owner did not understand and merrily continued to dig out large tree stumps!
Owner had felled large Oaks because they had some dead wood!

Trying to get info out of some LPAs is like getting blood from a stone. At
least one of my local LPAs won't actually put a call through to a planner, a
switchboard person simply says I'll ask them to get back to you..... And
e-mails elicit a response of "we'll get back to you within a fortnight...."

Ha ha - fair question Alistair!

I didn’t see I was cagey, just that I don’t reveal all the background
reasons for making the enquiry! I have a collection of friendly but
ambiguous stock phrases when quizzed!

Not that I'd ever ask why, because it's fairly obvious, but isn't
being
cagey about it more likely to illicit a new TPO response? 😉

In the past I have had clients ask me not to check about TPOs as
they
have been concerned that a phone call with the tree officer may
trigger a new TPO!

I agree that there’s no excuse for not checking when LPAs have
records
of CAs and TPOs online, but in the past I have experienced some tree
officers probing as to why I want to know (to which I have to politely
decline to expand on the enquiry) - clearly because they are concerned
about pre-emptive felling etc.

It’s a problem that seems to stem from a combative approach to
planning
between some developers and planning officers.

Could anyone advise as to why I appear to be receiving an
increasing
number of AIA's stating that no checks have been carried out with the
Local Planning Authority as to whether trees within the site are TPO'd
or lie within a Conservation Area particularly as BS5827:2012 clearly
states at
5.2.3 that the presence of TPO's and Conservation Areas is a factor to
be taken into account and are a material consideration (Annex B).

I understand that Consultants may have some difficulty in
obtaining
this information, particularly if its not online and there are tight
timescales, but it can become a little embarrassing when I have to
tell the applicant that his trees are TPO'd and his Consultant has not.
