A query to LPA officers who deal with 1997 Hedgerow Regs.
Do you ask for bat surveys when presented with a Hedgerow Removal
Notification? I ask, as there is no mention of this in the criteria of
importance, unless of-course the Regs have been quietly updated and I'm not
up to date.
I'm being told by our ecologist that here in Wales that we, as the LPA have a
duty under the Environment (Wales) Act to protect and enhance biodiversity
and promote the resilience of ecosystems, so should therefore ask for a
survey in an instance where major bat activity is known and is significant
etc. I'm not sure if there is an equivalent requirement in England or
elsewhere, but I can imagine situations that would rapidly progress to appeal
if refused on the grounds of no bat survey, or likely significant effect on
bat foraging or commuting routes.
