Hi Andy

We have had appeals go both ways on this subject on a number of occasions. 
It's not really something you can draw a common denominator from. It's 
completely site specific and open to considerable subjectivity from the 
inspector. The BRE guidance is particularly unhelpful as it offers no 
quantification for shade to gardens from trees. Instead it states this: “if 
the whole of the garden is shaded by trees for a lengthy period of time in 
summer, the garden is probably too shady”. Thanks BRE!

Hi

Can any one point me in the right direction for when an appeal has been up 
held against an LA who say shade is a reason for refusal for planning 
permission, I remember this being the case but I cant find the reference
