A qualified opinion about the tree seems to be the obvious requirement, and 
what is the problem with making the full application to remove the tree now 
that RCC has agreed?
In the UK, if a TPO tree is discovered to be imminently dangerous there is a 
5-day notice procedure, and if is literally about to fail then take 
photographic evidence to justify immediate removal as an emergency.
I don't have the impression that the tree is an emergency situation.
