There are two immediate powers afforded local authorities:
S.154 of the Highway Act 1990
https://www.legislation.gov.uk/ukpga/1980/66/section/154 ; and,
S.23 and 24 of the Local Government (Miscellaneous Provisions) Act 1976
https://www.legislation.gov.uk/ukpga/1976/57/section/23
If you want interpretation of the Misc. Prov. Act, I am pretty familiar with
it.

Dear all,
Are there powers available that will require a tree owner to remove a tree
that has been assessed by someone to be "dangerous" to third parties?
I know about S215 of the TCPA, but I don't think it applies to a dangerous
tree, does anyone know different?
Does the HSE have any powers?
Or is it simply a civil matter?
