I'm intrigued by cases like this - which mean that either Kirklees has 
misinterpreted the law or all the rest of us have and has been doing so for 
years, whoops.  If the former then surely the route to correction should be 
through the Ombudsman.  The case can't be appealed for "non-determination" as 
not validated, that and without a decision the inspectorate might be on the 
back foot!

Hello all,

A friend of mine has been having similar problems to me - in response to a 
recent application he submitted as an agent he got a letter from Kirklees 
which said this,

"*On the basis that the applicant does not live at or near the properties on 
xxxx Close and in the absence of clear evidence to show that they have a 
material interest as the occupier or land owner affected by the trees listed 
in the application, the Council will not be validating this application.*"

He going to appeal it, and he'll let us know the result - which will be well 
over a year under the 'fast track' route.
